Supreme Court decision on Oklahoma charter school: only a temporary setback?

CWN Editor's Note: Analyzing last week’s Supreme Court decision, in which a 4-4 tie vote upheld an Oklahoma decision barring state aid to a Catholic charter school, Andrea Picciotti-Bayer notes that Justice Amy Coney Barrett recused herself from the case, although she was not obliged to do so.

Had Justice Barrett joined in the decision, she likely would have tipped the balance toward the Catholic charter school, Picciotti-Bayer writes. Fortunately: “It’s only a matter of time before a case questioning the constitutionality of excluding religious schools from charter-school programs is before the high court once again.”
