a fresh new approach to banning abortions

By Phil Lawler ( bio - articles - email ) | Dec 17, 2010

Defenders of Obamacare argue that the broad health-care program, with its requirement for every American to purchase insurance, is constitutional because it is not a compulsion but a tax.  Writing on the Atlantic site, Megan McArdle uses the logic of that argument as a springboard for a novel approach to legislation on abortion:

Can Congress enact a $50,000 tax on second term abortions?

McArdle's argument is much more effective as a critique of Obamacare and its defenders than as a prescription for pro-life legislation. Still it's an interesting approach.

"not a compulsion but a tax" Oh, are we no longer compelled to pay taxes?
