California: immediate court challenges results of referendum barring same-sex marriage

November 06, 2008

Three separate lawsuits were filed by gay activists in California on November 5, challenging the constitutionality of Proposition 8, the referendum in which California voters banned legal recognition of same-sex marriage. The challenges are likely to find their way to the state's supreme court, which earlier this year ruled that recognition of same-sex marriage is required by the California constitution. (Proposition 8 was designed to overturn that ruling.) California Attorney General Jerry Brown has announced that he will defend the legal validity of the 16,000 same-sex marriages that have already been recognized by the state, while also defending the results of Proposition 8 against the court challenges.
