US appeals court upholds state laws against same-sex marriage, pushing question to Supreme Court

November 07, 2014

A US federal appeals court has upheld state laws defining marriage as a union between a man and a woman.

The decision, conflicting directly with other appeals-court findings, virtually guarantees that the issue will now be resolved by the Supreme Court.

In October, the Supreme Court declined to hear a challenge to another appeals-court decision that had overturned laws affirming the definition of marriage in Indiana, Oklahoma, Utah, Virginia, and Wisconsin. The new ruling by the 6th federal circuit court upholds such laws in Michigan, Ohio, Tennessee, and Kentucky.

Because the two appeals-court decisions are in direct conflict, the Supreme Court will be asked to step in and settle the issue of constitutional law.

The Washington Post headline is misleading. There is no ban or even mention of SS anything. Just a definition of marriage voted on by the citizens of these states. Given their cowardly decision to decline the earlier case, I take no comfort in the prospect of having the scotus involved in this matter at all. They've already demonstrated clearly, at least to me, what they think of the rule of law as exercised by the states. But God Bless the 6th circuit court of appeals!
