Italian court denies 'wrongful birth' suit

December 23, 2015

An Italian court has rejected a "wrongful birth" lawsuit brought by the parents of a Down-syndrome child.

The Supreme Court of Cassation dismissed the parents' argument that they should have been informed of the child's condition before birth, so that they might have procured an abortion. The court said that there is no right not to be born.

Recognizing the parents' argument, the court found, would "make the parents the unilateral interpreters" of the will of the unborn child.

I pray that this child will convey great peace and joy to the family that is so hostile to him. There is no love quite like that given by a child with Down Syndrome.
