Indiana judge affirms discrimination judgment against diocese in teacher's in vitro case

March 10, 2015

A federal judge in Indiana has ruled against the Diocese of Fort Wayne-South Bend, refusing to set aside a jury’s decision to award damages to a Catholic-school teacher who was dismissed after undergoing in vitro fertilization.

The teacher, Emily Herx, originally was awarded $1.9 in damages by the jury that found the diocese had illegally discriminated against her. A judge later reduced that sum to $540,000.

The diocese had argued, unsuccessfully, that the decision not to rehire Herx was made because, by opting for in vitro fertilization, she had engaged in a public repudiation of Catholic moral teaching. In finding the decision discriminatory, the court had ruled that Herx was dismissed because she was pregnant.

What! She did not understand the teachings of the Church on this subject. Another secular court imposing what it believes should be your beliefs. Hope they appeal this idiot.
