Peruvian Catholic university faces loss of Catholic status

September 01, 2011

Cardinal Juan Cipriani of Lima, Peru, is hoping to avoid a direct confrontation between the Vatican and the Catholic University of Lima.

In 2007, the Catholic University—which carries the title of a pontifical university—decided not to include the Archbishop of Lima as an ex officio member of its board of directors. Although a Peruvian court ruled that the university was required to give the archbishop a seat, under the terms of a major donor’s bequest, the school has not yet done so.

In August, the Vatican ordered university officials to amend the school’s statutes, bringing the institution into accord with the terms of Ex Corde Ecclesiae. Again, university officials refused. Vatican officials have warned that as a result, the school could be stripped of its status as a pontifical university.

The trustee for this major donor's estate should sue the university, demanding the return of the bequest plus any appreciation in its value. Why should there be any discussion with the school. The university, after all, did accept the bequest under the stipulation that the archbishop of Lima be an ex-officio member of the school's board of trustees. If the school will not live up to this condition, they should return the money. Let this be a lesson for all potential donors.
